& Consent Process

You are receiving this notice because a lawsuit against Rosewood Village Associates LLC ("RVA") settled. In the lawsuit (the "Action"), named Plaintiff Casey Crantz alleged certain unpaid overtime claims under the Fair Labor Standards Act ("FLSA"), Virginia Overtime Wage Act ("VOWA"), and Virginia Wage Payment Act ("VWPA"), on her behalf and on behalf of other similarly situated individuals, related to an alleged automatic deduction from paid working time each shift for meal periods.

Plaintiff alleged that the deduction was impermissible under applicable law when the affected employees were not completely relieved from duty, and therefore did not receive bona fide meal periods, for the time deducted from their pay. RVA denies these allegations and contends that it lawfully and properly paid you for your work and that the meal period deductions were permissible.

The settlement provides a Settlement Total Amount of up to $271,500.00 to be paid by RVA, in addition to employer-side payroll taxes. Of this amount, $163,950.00 is the "Settlement Class Amount," allocated pro rata between eligible class members based on individual damages calculations. The Opt-In Period ends on June 29, 2026.

If you are an eligible Class Member, you have two basic options:

1. 1 Sign and return the Notice of Consent to Participate in Settlement no later than June 29, 2026. If you do, the Claims Administrator will deliver or mail a check to you (before tax withholdings) at your address on file after the Opt-In Period ends. By participating, you are bound by the outcome of the settlement agreement approved by the U.S. District Court for the Western District of Virginia on April 20, 2026 and agree to release the auto-deduction claims described in the Notice.
   
   Your Individual Settlement Amount will be divided evenly: 50% treated as wages (subject to payroll tax withholdings, reported on IRS Form W-2) and 50% treated as liquidated damages (no deductions, reported on IRS Form 1099).
   
   You may sign and return your Notice of Consent by mail or online here or via the navigation menu above.
2. 2 Do Nothing. You are not required to participate in this settlement. If you do not wish to do so, simply do nothing and you will not receive a payment, will not release any claims, and will not be bound by or be a participant in this settlement.

It is your responsibility to keep a current address on file with the Claims Administrator to ensure receipt of your Settlement Award. If you fail to keep your address current, you may not receive your Settlement Award. If you participate in the settlement, you shall be solely responsible for all tax obligations, reporting, and/or liabilities that result from the receipt of your payment.
